Phony Bail Bonds Scheme

On Wednesday, October 8, 2014, the Berks County Detectives Office was assigned to investigate a scheme involving Ace Bail Bonds and their distribution of "phony bail bonds" which were fraudulent or counterfeit, and had been altered, scanned and/or photocopied. It was subsequently learned that these "phony bail bonds" were executed at the Berks County Clerk of Courts Office, Reading Central Court which is commonly called Central Arraignment Court, as well as several Berks County Magisterial District Judge's Offices.

During the investigation, it was learned that Vincent Smith is the majority owner of Ace Bail Bonds and that Marcel Centeno is co-owner of the business. Vincent Smith runs the Ace Bail Bonds office and the business which is headquartered at 15 North 6th Street, Reading. It was also learned that Kaley Smith is a managing and licensed Bail Agent for Pennsylvania.

As a result of the on-going criminal investigation, it was learned that Kaley Elizabeth Smith, Supervising Agent for Pennsylvania employed by Ace Bail Bonds, has used, completed, written and/or executed a fraudulent Crum & Forster Indemnity Company Power of Attorney (bond) at least eight (8) times in Berks County between August 1, 2014, and September 29, 2014.

Additionally, Dean Scott Gurney, Bail Agent and Professional Bail Bondsman for Ace Bail Bonds, has used, completed, written and/or executed a fraudulent Crum & Forster Indemnity Company Power of Attorney (bond) at least fifteen (15) times in Berks County between August 1, 2014, and September 29, 2014.

The on-going illegal scheme of utilizing the "phony bail bonds" allowed Ace Bail Bonds to retain 100% of the Bail Bond Premium which is money they collected from the indemnitors, and avoid paying the 1% Premium to Cutting Edge Bail Bonds and the 1% BUF, which is the Build-Up Fund also payable to Cutting Edge Bail Bonds.

During the investigation, it was learned that Adalberto Garcia, Jr., the Executive Assistant for Ace Bail Bondsutilized Microsoft Publisher to create and duplicate the "phony bail bonds" along with a text box to white out the Power Number/s and Power Amount/s.

As a result of the cooperative effort between the staff in the Berks County Clerk of Courts Office and the Berks County Detectives Office, the diligent search yielded approximately 45 "phony bail bonds" which have been either duplicated, photocopies and/or scanned, and some have been altered. All the original paperwork which was completed and filed by the Bail Agent/Professional Bondsman from Ace Bail Bonds, were removed from these files and turned over to the Berks County Detectives Office.

To date, we have identified and seized at least 83 "phony bail bonds" along with the associated Bail Bond documents.
