DETAILS OF INCIDENT:
On October 1, 2018, the Berks County Detective’s Office filed the following criminal charges against the defendant, Holly Anne Smith, Berks County Docket #CP-06-CR-0005205-2018:
Institutional Sexual Assault
Corruption of Minors
Unlawful Contact with Minor
Endangering Welfare of Children
On October 9, 2018, Smith was arraigned and released on $25,000.00 unsecured bail. There was a bail condition in place, which was “No Contact” with the victim.
On March 28, 2019, the defendant, Holly Anne Smith entered a “Guilty Plea” before a Berks County Common Pleas Judge to the charge of Institutional Sexual Assault. Those charges were relative to an ongoing intimate sexual relationship she was having with one of her (16) sixteen-year-old male students while she was employed as a Hamburg School District teacher.
Smith is scheduled to be sentenced on July 8, 2019.
Subsequently, on May 15, 2019, the Berks County Detective’s Office received additional information that Holly Anne Smith continued to secretly communicate with the victim via text messaging. The Berks County Detective’s Office recovered copies of the text message exchanges between the Smith and the victim from January 2, 2019 until May 17, 2019.
On May 23, 2019, the Berks County Detective’s Office, assisted by Police Chief Livergood, West Mahanoy Township Police Department, obtained a search warrant to seize the cellular telephone belonging to the Holly Anne Smith, who currently resides in Shenandoah, PA.
On May 24, 2019, the Search Warrant was served at the defendant’s current residence. Smith surrendered a cellular telephone to the West Mahanoy Township Police Department. It was later determined that Smith intentionally provided the wrong cellular telephone to law enforcement.
On May 30, 2019, the Berks County Detective’s Office filed criminal charges against Holly Anne Smith, at Magisterial District Judge Kim L. Bagenstose’s Office. M.D.J. Bagenstose issued an arrest warrant for the defendant.
On May 24, 2019, members of the Berks County Detective’s Office took Smith into custody at 325 Florida Avenue, Shenandoah, Pennsylvania.
She was returned to Berks County and transported directly to the Berks County Sheriff’s Central Processing Center to be fingerprinted and photographed.
The defendant, Holly Anne Smith, was arraigned via video by Senior Magisterial District Judge Thomas Xavios. He set bail at $50,000.00 Secured. Smith posted bail and was released shortly afterwards.
As in every criminal case, the fact that an arrest has occurred or a complaint has been filed is merely an accusation, and the defendant Holly Anne Smith, is presumed innocent until and unless proven guilty.
