DEFENDANT SURREPTITIOUSLY PHOTOGRAPHED FEMALES

This investigation started back on Sunday, June 17, 2018 @ 10:48 a.m. at the Lowe’s located at 2625 Shillington Road, Sinking Spring (Spring Township).
 
The defendant, Eric Milus, was observed taking “Upskirt” photographs of an unsuspecting adult female victim, while she was shopping inside the Lowe’s store. A witness, who was standing in close proximity to the female victim, as well as the defendant Eric Milus, confronted the defendant who immediately fled the Lowe’s store. The witness pursued the defendant out of the Lowe’s store and followed the defendant to his vehicle. The witness, along with other good Samaritans, detained the defendant until Spring Township Police Officers arrived at the scene.
 
The defendant, Eric Milus, was briefly interviewed by the Spring Township Police Officers at the scene. He immediately surrendered his Apple IPhone after admitting that he did in fact utilize his cellular telephone while surreptitiously capturing “Upskirt” photographs of the female victim without her knowledge or consent.
 
On August 21, 2018, the investigation was referred to the Berks County District Attorney’s Detectives.
 
The Spring Township Police Department immediately forwarded their investigative file along with the defendant’s Apple IPhone to the Berks County Detective’s Office for further investigation.
 

The defendant’s Apple IPhone was forensically examined by a Computer Forensic Specialist from the District Attorney’s Forensic Services Unit.

Upon examining and analyzing all the saved and stored data which exceeded over seven thousand five hundred files, Detectives identified at least (31) thirty one locations involving innocent females who were victimized by the defendant’s surreptitious criminal behavior.  To date, three of the thirty-one female victims have been identified as Berks County residents and one was identified as a fifteen year old female.

On Thursday, November 8, 2018, the Berks County Detective’s Office filed criminal charges and obtained an arrest warrant for Eric James Milus at Magisterial District Judge Ann Young’s Office. He was charged with:
  • Sexual Abuse of Children - Felony 2
  • Criminal Use of Communication Facility - Felony 3
  • Invasion of Privacy (30 counts) - Misdemeanor 2
  • Criminal Attempt to Commit Invasion of Privacy - Misdemeanor 2
 On Friday, November 9, 2018 at approximately 11:00 a.m., Eric James Milus surrendered to the Berks County Detective’s at their office.  Milus was accompanied by his attorney. 
 
The defendant was arraignment before Magisterial District Judge Ann Young. Bail was set at $50,000 unsecured and the defendant was released awaiting further court hearings.
 
The defendant’s criminal behavior not only included locations within Berks County, but also extended into Lancaster County, Montgomery County, Chester County, New Jersey and Texas.
 

The Berks County District Attorney’s Office will be handling the Prosecution of the offenses which have occurred within the Commonwealth of Pennsylvania and have already received McPhail letters from the respective District Attorney’s Office in each County where females have been victimized.

To date, most of the female victims are listed as “Jane Doe” and have not been positively identified.
