Drug Delivery Resulting in Death
Defendant: Sylvester Morales Jacobs, Age 29
On December 27, 2017, the Colebrookdale Police Department was dispatched to a residence in Boyertown for a male victim in cardiac arrest. Upon arriving on location, the responding officers approached the home and discovered a 23 year old male lying outside on the ground. The male was unresponsive and was being administered CPR by family members. Police officers attached an AED device to the male as well as administering Naloxone until EMS arrived on the scene. EMS assumed treatment of the male and transported him to the Pottstown Medical Hospital for treatment. Police officers collected drug paraphernalia evidence from the scene, including a cellphone, and small vials believed to contain controlled substances. These are items consistent with illegal drug use of heroin; possibly laced in fentanyl.
On December 29, 2017, the male victim died while at Pottstown Memorial Medical Hospital. The Montgomery County Coroner's Office performed an autopsy on the male and determined that the manner of death was accidental due to Fentanyl Toxicity.
The Colebrookdale Police Department initiated a death investigation and contacted the Berks County District Attorney’s Detectives Unit to assist in the investigation. Based on information received and investigation conducted, the investigating officers strongly believed that the male victim had taken heroin, which was possibly laced with fentanyl, earlier the same day.
On December 29, 2017, Colebrookdale Police Department turned over evidence concerning the death via overdose drug investigation to the Berks County District Attorney’s Detectives Unit for further investigation.
On April 23, 2018, the Berks County Detectives Unit obtained a search warrant from Magisterial District Judge Sandra Fegley relative to obtaining a Buccal Swab from the suspect, Sylvester Jacobs, for the purpose of collecting a DNA sample. The next day, on April 24, 2018, the search warrant was served upon Jacobs. The Buccal Swab was packaged and later sent it to the Bethlehem Regional Lab for comparison with the DNA found on evidence retrieved form the crime scene.
On May 22, 2018, the Berks County Detectives Unit received a copy of official Lab Report from the Bethlehem PSP Lab, relative to the overdose death investigation. Forensic DNA Scientists determined that the major component of the DNA mixture submitted matched the DNA profile of Sylvester Jacobs.
As the investigation continued, the Berks County Detectives were able to determine that Sylvester Morales Jacobs was the source of the fentanyl ingested by the male victim, which caused his death. A warrant of arrest for Jacobs was obtained charging him with Drug Delivery Resulting in Death and related charges.
On December 20, 2018, Sylvester Morales Jacobs was arrested without incident on the 800 block of Reading Ave, Boyertown PA, and was transported to the Berks County Sheriff’s Department Central Processing Center for processing and arraignment. Bail was set at $100,000 and he currently remains in Berks County Jail awaiting further court action.
