The following drug were involved in the case heroin, fentanyl, cocaine, methamphetamine, and marijuana.
 
DETAILS OF INCIDENT:
 
On Saturday, December 5, 2020, members of the Eastern Berks Regional Police Department were dispatched to 1218 Montgomery Avenue, Boyertown, PA, relative to an unresponsive male. At approximately 2:40 p.m., officers arrived on scene and located a deceased thirty-one (31) year old male victim. While in the home officers observed heroin/fentanyl usage, including, twelve blue packets of heroin/fentanyl and the victim’s cellular phone.
 
Based on evidence of a fatal drug overdose, Eastern Berks Regional Police Department contacted the Berks County Detective’s Office. On Saturday, December 5, 2020, the Eastern Berks Police Department along with Berks County Detectives initiated a drug investigation involving an overdose death and the sales of heroin/fentanyl in Boyertown, PA.  During the investigation, it was believed that the defendant, Jesus Cruz was dealing heroin/fentanyl to the Boyertown comminute from his residence at 229 S. Reading Ave, 1st floor apt, Boyertown, PA. 
 
On Sunday, December 6, 2020, at approximately 11:53 a.m., the officers observed a silver Suzuki Grand Vitro bearing PA arrived at 229 S. Reading Avenue, Boyertown, PA.  The defendant, Jesus Cruz entered the vehicle and the vehicle drove away.  The driver of the vehicle was the second defendant, Keyaira Nunez-Trego.  At 12:05 p.m., Eastern Berks Police Department along with Berks County Detectives initiated a traffic stop.  The defendant, Jesus Cruz was detained and found in the vehicle where Cruz was sitting was a black Keltec 9mm firearm and five blue packets of suspected heroin/fentanyl.  Cruz was taken into custody. The investigation discovered the that defendant, Nunez-Trego is Cruz’s girlfriend and they lived at 229 S. Reading Avenue, Boyertown, PA, together.
 
On Sunday, December 6, 2020, at approximately at 5:00 p.m. based on the investigation, the Berks County detectives obtained a search warrant for Nunez-Trego and Jesus Cruz’s apartment.  The search warrant was issued by District Justice Michael Hartman for the premises at 229 S. Reading Avenue, 1st fl. apt., Boyertown, PA. 
 
At 5:07 PM, members of the Berks County Detectives Office and the Eastern Berks Police Department executed the search warrant at 229 S. Reading Ave, Boyertown, PA.  As a result of the search found and seized were:
 
Ø  Over 130 - 22mm and 9mm rounds
Ø  Numerous drug paraphernalia
Ø  A quantity of suspected heroin, fentanyl, cocaine, and marijuana
Ø  U.S. Currency
Ø  A second Keltec handgun
Ø  Documents related to Jesus Cruz and Nunez-Trego
 
On Sunday, December 6, 2020, the defendant, Jesus Cruz was charged with: Possession with the Intent to Deliver Heroin/Fentanyl, Cocaine & Marijuana, Possession of Heroin/Fentanyl, Cocaine & Marijuana, Possession of Drug Paraphernalia and Firearms Not To Be Carried Without A License.  At that time, Cruz was incarcerated at the Berks County Jail in lieu of bail.
 
The investigation continued:
On Monday, December 7, 2020, Forensic Pathologist Dr. Supriya Kuruvilla MD performed an autopsy on the deceased male victim.
 
On Saturday, January 2, 2021, NMS Labs Scientist Jennifer Swatek certified a toxicology report detailing the deceased male victim, blood examination. The report identified, among other items, 4-ANPP (despropionyl fentanyl), fentanyl and norfentanyl from the victim’s specimen.
 
On Thursday, January 21, 2021, final autopsy report and death certificate were issued for the male victim indicating that cause of death was acute fentanyl toxicity.
 
On Tuesday, February 23, 2021, the defendants, Jesus Cruz, and Keyaira Nunez-Trego were charged with the above new and additional charges as. Cruz is presently incarcerated at the Berks County Jail.  The defendant, Nunez-Trego will be turning herself in to the authorities.
Subsequently, the defendants, Jesus Cruz and Keyaira Nunez-Trego will be processed at Berks County Sheriff’s Department Central Processing Center and arraigned by Magisterial District Judge Michael G. Hartman. Jesus Cruz's bail was set at $1 million and Keiyaira Nunez-Trego's bail was set at $25,000 unsecured.
 
As in every criminal case, the fact that an arrest occurred or a complaint has been filed is merely an accusation, a defendant is presumed innocent until and unless proven guilty.
