Notice is given that the Board of Supervisors of Hereford Township, Berks County, Pa, will hold a public hearing on September 14, 2009 at 7:00 pm at the Hereford Township Municipal Building, 3131 Seisholtzville Road, Macungie, Pa 18062 to consider the request for Curative Amendment of Radnor Development Company, L.P. (Radnor).  On June 17, 2008 Radnor, through Counsel, sent a letter and a plan requesting a Curative Amendment.  On June 27, 2008, Radnor, through Counsel, forwarded a proposed Ordinance and on July 7, 2008, Radnor submitted an Application.  On February 2, 2009, (entered April 16, 2009), the Court ordered a hearing on these matters and this public hearing is to fulfill the requirements of that Order.

 

          The Curative Amendment proposed by Radnor alleges that the Hereford Township Zoning Ordinance No. 2007-01 is exclusionary because it fails to provide for a housing type known as a Continuing Care Retirement Community and Radnor therefore seeks to locate such a facility containing 1,650 units plus assisted living and skilled nursing facilities and other uses in the agricultural preservation zone on property owned by K&K Clayton Enterprises, Inc. located at the intersection of Pa State Route 100 and Kutztown Road, in Hereford Township, Berks County, Pa.
