RAPE & SEXUAL ASSAULT OF A CHILD

DETAILS OF INCIDENT:
 
On January 26, 2021, the Reading Police Department contacted the Berks County Detective’s Office, regarding a Rape and Sexual Assault of a twelve-year-old female child.
 
This notification was in compliance with the Berks County Child Abuse Protocol, which was implemented by District Attorney John T. Adams.
 
The Berks County Detective’s Office initiated a criminal investigation, which yielded the following information:
 
On January 26, 2021, the twelve-year-old victim was examined by medical staff at the Reading Hospital and Medical Center, (Tower Health).  During this examination items of physical and biological evidence were collected, which were turned over to the Berks County Detective’s Office.
 
On January 27, 2021, a forensic interview was conducted at the Children’s Alliance Center. During this interview, the victim disclosed and provided specific details related to the rape and sexual assault which occurred on two separate occasions.
 
The victim reported the assaults occurred on January 25 and 26, inside her residence.
 
The suspect was identified as Elder Jacobo-Portal, who resided with the victim and her family, in the 200 block of N. 9th Street, Reading, Berks County, Pennsylvania.
 
Items of evidence were collected and submitted to the Pennsylvania State Police Crime Lab located in Bethlehem, Pennsylvania, for further DNA analysis and comparison.
 
On April 21, 2021, the Berks County Detective’s Office received the DNA report from the Pennsylvania State Police Crime Lab. The Forensic Scientist from the PSP Crime Lab assigned to this case, concluded that evidence collected from the victim contained biological evidence which is consistent with the defendant’s DNA.
 
On May 19, 2021, the Berks County Detectives filed criminal charges against the defendant, Elder Jacobo-Portal, at Magisterial District Judge Kyley Scott’s Office.
 
M.D.J. Scott issued an arrest warrant for the defendant.
 
On May 20, 2021, at approximately 4:20 p.m., the Berks County Detectives apprehended the defendant at his residence located in the 100 block of Windsor Street, Reading.
 
The defendant was taken into custody and immediately transported to the Central Processing Center where he was released into the custody of the Berks County Sheriff’s Department.
 
The defendant was fingerprinted and photographed. 
 
M.D.J. Kim Bagenstose presided over the defendant’s preliminary arraignment which was held via video. She set bail at $100,000.00 and the defendant was committed to Berks County Jail pending his Preliminary Hearing which will be held at a later date.
 
As in every criminal case, the fact that an arrest occurred or a complaint has been filed is merely an accusation, and the defendant Elder Jacobo-Portal, is presumed innocent until and unless proven guilty.
