VIOLATION OF PROTECTION FROM ABUSE ORDER

DETAILS OF INCIDENT:
On May 8, 2020, the Berks County Detective’s Office received a report from Berks County Children & Youth Services, which involved a violation of a Protection from Abuse Order.
The Berks County Detective’s Office initiated an investigation which yielded the following information:
On December 24, 2018, a Final Protection from Abuse Order #18-19165 was issued by a Court of Commen Pleas Judge in Berks County. The Plaintiff was a parent, who filed the petition for Protection from Abuse on behalf of the son, who was only seventeen years old at the time.
The defendant in the Final Protection from Abuse Order was identified as Holly Anne Smith.
On April 18, 2020, the defendant, Holly Smith was released from Berks County Jail after serving her Court ordered period of incarceration related to Indecent Sexual Assault.
On April 24, 2020, the defendant contacted the male victim, who was identified in the Final Protective Order, as the Plaintiff’s seventeen-year-old son.
The victim reported the defendant repeatedly sent him messages via Facebook messenger, which were sexual in nature and she requested to meet with him. The victim replied, “leave me alone” and he reminded the defendant, “remember you have a restraining order”.
The defendant continued to send the victim messages even after he replied, “get away from me”.
This did not stop the defendant.
On May 18, 2020, the Berks County Detectives interviewed the victim and recovered evidence of the electronic communications between the defendant and the victim. The contact, which was initiated by the defendant with the victim, is a violation of the Final Protection from Abuse Order, which was issued back on December 24, 2018.
On May 18, 2020, the detectives filed criminal charges against the defendant, Holly Smith, at Magisterial District Judge Andrea Book’s Office and an arrest warrant was issued.
On May 22, 2020, at approximately 11:30 AM, the defendant reported to the Berks County Detective’s Office and surrendered. She was immediately taken into custody and escorted to the Berks County Sheriff’s Central Processing Center for processing and video preliminary arraignment. Bail was set at $1,000. She is currently incarcerated in Berks County Jail due to a parole violation.
As in every criminal case, the fact that an arrest has occurred or a complaint has been filed is merely an accusation, and the defendant Holly Anne Smith, is presumed innocent until and unless proven guilty.
