Parking Ticket Procedures - Disputes
Berks County > Police Departments > Kutztown Borough Police Department

If you have received a Parking Ticket issued by Kutztown Borough Police Department personnel and you desire to dispute the Parking Ticket:

1)    Download the Kutztown Borough Police Department Parking Ticket Appeal Form or complete and submit the On-Line Parking Ticket Appeal Form (Special Note: The On-Line Parking Ticket Appeal Form will only work with Internet Explorer or Mozilla Firefox Web Browser).  Any appeal to a parking ticket MUST be submitted to the Kutztown Borough Police Department within twenty (20) days from the date that the parking ticket was issued or the appeal WILL NOT be considered.

a.   To use the Parking Ticket Appeal Form, download the form using Adobe Acrobat viewer and print out the form.  The form should be completed and returned to the Kutztown Borough Police Department within twenty (20) days from the date the parking ticket was issued.  The On-Line Parking Ticket Appeal Form can be completed and submitted on-line.

b.     In the case of an appeal for a parking ticket issued for PARKING ON A PRIVATE LOT WITHOUT CONSENT (Box #12 on the parking ticket), the Parking Ticket recipient MUST contact the property owner and it is the responsibility of the property owner to contact the police if an appeal is to be considered.

c.   Any appeal claiming that the vehicle was disabled MUST be accompanied by supporting documentation of that disability.  Examples of this documentation would be sales or service receipts of repair of the vehicle indicating the date of repair or service.

2)     The Parking Ticket Appeal Form will be reviewed by the issuing officer and forwarded to the Chief of Police for final review and reconsideration.

3)     The person appealing the parking ticket will be notified within ten (10) days from the date that the Kutztown Borough Police Department received the notice of the appeal.  In the event that the appeal is denied, payment of the ticket will be required within ten (10) days from the date of the appeal decision.  Payment will not be required if the parking ticket is excused and the person appealing the ticket will be notified.

4)     If your appeal is denied and you do not make payment within the required time period, or if you desire to take your dispute directly to court, you may withhold payment and your Parking Ticket will be processed as a Pennsylvania traffic citation and forwarded to Magisterial District Court 23-03-04, 110 W. Arch St., Suite 118, Fleetwood, PA 19522.  You should then receive your copy of the Pennsylvania traffic citation in the mail.  Follow the instructions on the back of the Pennsylvania traffic citation for entering a plea .
